Kai was reportedly arrested in late May 2013 for the murder of Joseph Galfy, a man he met in Time Square after arriving in New York City from the West Coast. When officials caught Kai at a Philadelphia bus stop, he acknowledged the murder but claimed self-defense because Galfy had allegedly sexually assaulted him.

Multiple sources indicate that he filed a not-guilty plea and was incarcerated on a $2.9 million bond owing to his assessed risk. He was imprisoned for six years while awaiting his trial. In 2019, he was found guilty of first-degree murder and sentenced to 57 years in prison.
